The petitioner seeks bail in Kishanpur P.S. case No. 204 of 2016 under Section 414 of the Indian Penal Code and under Section 25(1-b) a, 26, 35 of the Arms Act.
From the possession of the petitioner one loaded country made pistol and four live cartridges were recovered. It is submitted that petitioner is in jail since 03.10.2016 but it appears that the petitioner has got criminal antecedent and he is accused in as many as 11 criminal cases. Considering the facts aforesaid, I am not inclined to enlarge the petitioner on bail, at this stage. Accordingly, the same is rejected.
The trial court is directed to expedite the trial and
Patna High Court Cr.Misc. No.11973 of 2017 (4) dt.20-06-2017 2/2 conclude the same within six months from the date of receipt of this order.
If the trial is not concluded within six months, the petitioner may renew his prayer for bail.
