JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341/323/366A/120B/34 of the Indian Penal Code. The accusation is of kidnapping the minor daughter of the informant. In the statement, recorded under section 164 Cr.P.C., the victim girl has alleged that on 18.12.2014 Avinash, Manjay and Vinay kidnapped her and took her to their house where this petitioner being mother of Avinash threatened the victim.
It is submitted by learned counsel for the petitioner that the thrust of accusation is against Avinash, Manjay and Vinay and petitioner being mother of co-accused Avinash has been maliciously roped. In view of statement made under section 164 Cr. P.C. no case under section 364 of the Indian Penal Code
Patna High Court Cr.Misc. No.13477 of 2015 (2) dt.06-05-2015 2/2 is made out against the petitioner. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the thrust of accusation against three male accused and petitioner being an old lady, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur in connection with Sakra P.S. Case No.13 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
