JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-02-2019 The petitioners apprehend their arrest in connection with Nabinagar (Badem) P.S.Case No. 200 of 2018 registered under Sections 149, 307, 323, 341, 354, 379 and 504 of the Indian penal Code.

At the very outset, it is submitted that during the pendency of this application, petitioner no. 1 has been arrested, as such this application against petitioner no. 1 has been dismissed as withdrawn.

Allegation against the petitioners and other co-accused is

Patna High Court CR. MISC. No.11882 of 2019(2) dt.27-02-2019 2/2 that they caught hold the son of the informant and petitioners assaulted him by lathi and danda and also snatched silver chain and also taken Rs. 2000/- from his pocket.

Submission of learned counsel for the petitioners is that no specific allegation has been attributed against them and there is case and counter case in between the parties and the injuries are found simple in nature which will appear from Annexure-2. Heard learned APP also.

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner nos. 2 to 7, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Aurangabad in connection with Nabinagar (Badem) P.S. Case No. 200 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) sujit/- U T
