JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-07-2017 The petitioner seeks regular bail in connection with Warsaliganj P.S. Case No. 268 of 2016, registered for offences punishable under Section 302/201of the Indian Penal Code. It has been submitted on behalf of the petitioner that save and except the theory that the petitioner was last seen with the deceased, there is absolutely nothing against him so as to connect him in the present case and though he has made confession in this case but he has not stated anything about himself. Further during investigation, it has come that the deceased had relationship with one girl and due to which he might have been killed by some other person Learned counsel for the State as well as learned counsel

Patna High Court Cr.Misc. No.23845 of 2017 (3) dt.18-07-2017 2/2 for the informant opposed the prayer for bail on the ground that the conduct of the petitioner after the occurrence clearly suggests his involvement in the said offence.

Having heard both sides, considering the facts and circumstances of the case and the nature of allegation, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, rejected.

However, the petitioner may renew his prayer for bail after framing of charge in the court below itself and if any such application is filed, the court below after considering the materials available on record at that time, shall pass an appropriate order, without being prejudiced by the order of this Court.
