JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-04-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 366A/34 of the Indian Penal Code.

The accusation is of abducting the minor daughter of the informant.

It is submitted by learned counsel for the petitioner that victim appeared before the learned court below and stated that she voluntarily married with this petitioner. The petitioner claims that the victim is residing with the petitioner as wife. Considering the aforesaid facts, let the above named petitioner be released on provisional anticipatory bail for a period of three months, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on

Patna High Court Cr.Misc. No.12812 of 2015 (3) dt.01-04-2015 2/2 furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in connection with Dighwara P.S. Case No. 171 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.

Let the petitioner produce the victim girl before the learned Court below on 27th April 2015 when the learned court below will record statement of victim girl and if she admits that she of her own married with the petitioner, the provisional bail of petitioner will be confirmed by the learned court below, otherwise, the petitioner will surrender and pray for regular bail.
