The petitioner seeks bail in a case instituted under Sections 25(1-b)a 26, 27, 35 of the Arms Act and Sections 3, 4 & 5 of Explosive Substance Act.
It is alleged that 32 detonators and five cartridges are said to have been recovered from the possession of the co-accused Manoj Yadav.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 04.07.2016. The charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. It is alleged that one country made rifle, two country made pistols, 18 live
Patna High Court Cr.Misc. No.23784 of 2017 (2) dt.24-05-2017 2/2 cartridges along with four empty cartridges are said to have been recovered. There is no compliance of Section 100 of the Cr.P.C. The other co-accused have been granted bail vide Annexure-2 series, to the present application.
On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-8th, Rohtas in connection with S.T. No. 537 of 2016, corresponding to Shiv Sager (Baddi) P.S. Case No. 186 of 2016. (Sudhir Singh, J) Amit/- U T
