JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-03-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Bishambharpur P.S. Case No. 78 of 2014 registered for the offences punishable under Sections 272, 273, 341, 353/34 of the Indian Penal Code and 47 A of the Excise Act. The name of petitioner no. 1 came in the statement of co-accused, Karilal Sah who was caught by the police officials selling illicit country made wine and thereafter the house of petitioner no. 1 was raided and from his house, 35 litres sprit, packing machine, polythenes etc. were recovered. So far as petitioners no. 2 to 4 are concerned, it is alleged that when police

Patna High Court Cr.Misc. No.10802 of 2015 (2) dt.20-03-2015 party made raid in the house of the petitioner no. 1, the petitioners no. 2 to 4 and others made obstruction in conducting the raid. Considering the aforesaid facts and circumstances as well as submissions of the parties, it is ordered that petitioners no. 2 to 4, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Chandravir Singh, Judicial Magistrate 1st Class, Gopalganj in Bishambharpur P.S. Case No. 78 of 2014 subject to condition as laid down under Section 438(2) of the Cr.P.C. So far as petitioner no. 1, namely, Raj Kumar Yadav is concerned, his prayer for anticipatory bail stands rejected.
