JUSTICE SANJAY PRIYA ORAL ORDER 23-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Motihari Town P.S. Case No. 565 of 2016 instituted for the offence under Sections-413, 414/34 of the Indian Penal Code.

It has been submitted that the petitioner is in custody since 01-09-2016. It has further been submitted that no TIP has been held till date. There is allegation against the petitioner that one golden chain and a motorcycle have been recovered from his possession but from the impugned order itself, it appears that no TIP of the aforesaid articles was done by the police. Therefore, keeping in view the period spent by the petitioner in custody, the prayer for bail is allowed and the petitioner named above, is directed to be released on bail on

Patna High Court Cr.Misc. No.23709 of 2017 (2) dt.23-05-2017 2/2 furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Motihari Town P.S. Case No. 565 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran subject to condition that both the bailors should be close relatives of the petitioner.
