Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Alamganj P.S.Case No. 120 of 2013 registered for the offences punishable under Sections 419,420,467,468,379,274,275,276 and 120B of the Indian Penal Code and 27(b)(ii)28(A),28,27(d),18 (1)(ii) of the Amendment Act 2008 of drug and cosmetic Act and 27a/c 36A (c) and 08/16 of N.D.P.S Act and section 2 of D& C Act being Special Case no. 26 of 2013.

At the very outset, learned counsel for the petitioner drew my attention towards page -30 of the petition and submits

Patna High Court Cr.Misc. No.30783 of 2013 (5) dt.23-06-2015 2/2 that petitioner was holding valid license for storage and selling of the medicine and furthermore, it is submitted on behalf of the petitioner that seized medicine have already been released in favour of the petitioner.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Patna in Special Case no. 26 of 2013 arising out of Alamganj P.S.Case No. 120 of 2013, subject to condition as laid down under Section 438(2) of the Cr.P.C.
