JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-03-2018 Earlier prayer for bail of the petitioner was dismissed vide order dated 27.07.2017 passed in Cr. Misc. No. 34330 of 2017 with direction to the Trial Court to expedite the trial and conclude the same within a period of six months. Submission of learned counsel for the petitioner is that the case is under Section 414 of the Indian Penal Code and Section 25(1) of Antiquity Act and petitioner has been in judicial custody since 17.04.2017 and uptil now no substantive progress has been made in the Trial.

Heard learned A.P.P. also.

Considering the aforementioned facts and circumstances of the case and the period of custody, let the petitioner above named, be released on bail on furnishing bail

Patna High Court Cr.Misc. No.12145 of 2018 (3) dt.28-03-2018 2/2 bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Munger, in connection with Munger Muffasil P.S. Case No. 81 of 2017, with following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part two appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.
