1. Heard Mr. Anand Vardhan, learned counsel for the petitioner and learned A.P.P. for the State.

2. Learned counsel appearing on behalf of the petitioner submits that petitioner was granted the privilege of anticipatory bail by order dated 20.01.2026 in Cr. Misc. No. 86218 of 2025 but then petitioner was arrested prior to the order dated 20.01.2026 in Cr. Misc. No. 86218 of 2025 but then the said fact could not be brougt to the notice of the Court when Cr. Misc. No. 86218 of 2025 was taken up on 20.01.2026. It is further submitted that petitioner was arrested in the case prior to 20.01.2026 and was remanded to judicial custody but then his regular bail application is not being considered by the learned District Court for the reason that he has obtained anticipatory bail as recorded hereinabove. It is, thus, submitted that the

Patna High Court CR. MISC. No.15074 of 2026(2) dt.25-02-2026 2/2 instant modification application has been filed for seeking modification of the order dated 20.01.2026 in Cr. Misc. No. 86218 of 2025 to the extent that in the order dated 20.01.2026 in Cr. Misc. No. 86218 of 2025 it be rcorded that the anticipatory bail application with respect to Shivdutt Manjhi (petitioner) is permitted to be withdrawn in view of the fact that he was arrested on 09.12.2025 i.e. much prior to the order dated 20.01.2026 in Cr. Misc. No. 86218 of 2025.

3. After hearing the learned counsel for the parties, the order dated 20.01.2026 in Cr. Misc. No. 86218 of 2025 is modified with respect to Shivdutt Manjhi that Cr. Misc. No. 86218 of 2025 is withdrawn with respect to Shivdutt Manjhi as he was arrested in the case on 09.12.2025. The rest of the order shall remain the same.

4. Accordingly, the modification application is allowed.
