The petitioner seeks bail in a case registered under Sections 25(1-b)a/26/35 of the Arms Act.

Allegation is that two loaded masket rifle, one loaded country made pistol and one live cartridge are recovered. It has been submitted on behalf of the petitioner that the petitioner is in custody since 22.02.2018. Charge sheet has been submitted in the case. There is no allegation of tampering of witnesses alleged against the petitioner. Petitioner has falsely been implicated in the present case. Two loaded masket rifle, one loaded country made pistol and one live cartridge are said to have been recovered. There is no recovery from the conscious possession of the petitioner. The petitioner has remained in

Patna High Court CR. MISC. No.12757 of 2019(3) dt.12-04-2019 2/2 custody for more than one year. There is no compliance of Section 100 of Cr.P.C.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. IInd, Bhagalpur in connection with Kahalgaon (Ghogha) P.S. case No.730 of 2017.
