JUSTICE SANJAY PRIYA ORAL ORDER 29-06-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Kotwali P.S. Case No. 47 of 2017 instituted for the offence under Sections-416, 418, 420, 465, 466, 467, 468, 471 and 420 of the Indian Penal Code. It is alleged in the written report that the informant who is police officer, received information that one person is committing forgery in admission for B.Ed. and other prestigious educational institutions near station golumbar. The informant apprehended a person, who disclosed his name as Sanjeev Kumar (petitioner). He also disclosed that he along with Shankar Singh has opened a consultancy office in Maharaja Kameshwar Complex and for providing admission in different prestigious educational institutions, they charge hefty amounts from candidates. Patna High Court Cr.Misc. No.24177 of 2017 (3) dt.29-06-2017 2/2 alleged that upon search, a laptop, charger, mobile etc. as mentioned in detail in the written report have been recovered. The C.D. has been received in this case.

Learned APP has submitted that confessional statement of this petitioner was recorded by the police wherein he has stated that he along with Shankar Singh is indulged in such type of occurrence. Besides the aforesaid confessional statement, there is no any other material in the case diary to level any specific overt act against the petitioner. The petitioner is said to be in custody since 29-01-2017.

In such circumstances, the prayer for bail is allowed and the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Kotwali P.S. Case No. 47 of 2017 to the satisfaction of learned Chief Judicial Magistrate, Patna subject to condition that both the bailors should be close relatives of the petitioner.
