The petitioners apprehend their arrest in Begusarai (Muffassil) (Singhoul) P.S. Case no. 379 of 2014, registered for the offences punishable under Sections 447, 341, 323, 307, 504, 506, 34 of the Indian Penal Code.
The informant made allegation against the petitioners that they all assaulted him with pistol when he went to save his son Dhiraj Kumar Singh. The informant got grievous injury on his head.
Considering the facts aforesaid, I am not inclined to enlarge petitioner no. 1 Gulshan Kumar on anticipatory bail.
Patna High Court Cr.Misc. No.15226 of 2015 (2) dt.15-05-2015 2/2 Accordingly, the same is rejected.
So far as the case of Khusbu Kumari (Petitioner no.2) is concerned, she is a girl and no specific allegation of assault made against her, she in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Begusarai (Muffassil) (Singhoul) P.S. Case No. 379/2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
