Petitioner apprehends arrest in registered for the offences punishable under Section sections 25(1-B)a, 26 and 35 of the Arms Act.

As per the prosecution case, 8 live cartridges and a Nokia mobile phone were recovered from the possession of the petitioner and he was taken into custody but somehow he fled away from the police custody.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. Learned counsel for the State opposes the prayer for bail submitting that the petitioner dared to flee away from the police custody though he was arrested and cartridges were

Patna High Court CR. MISC. No.13761 of 2022(2) dt.22-08-2022 2/2 recovered from his possession.

Considering the aforesaid facts, prayer for bail of the petitioner is refused with direction to surrender and seek regular bail which would be considered and disposed of on its own merit without prejudice.
