The writ application is filed for appropriate direction upon the Inspector General of Registration to place the village Ibrahimpur Circle in Barh Sub-Division under Developing Area and further direct the respondents to fix Market Value Rate (MVR) accordingly.
A counter affidavit has been filed. There is no rejoinder thereto.
Counsel for the State has drawn attention of the Court to the statements made in paragraphs 7 and 10 of the counter affidavit in order to justify the MVR of the village in question. The valuation of the Bihar Stamp (Prevention of under Valuation of Instrument)
Patna High Court CWJC No.14319 of 2013 (2) dt.16-03-2016 2/2 (Amendment) Rules, 2013 was in vogue for such enhancement in the MVR. The provision of the Rule is not under challenge. Even otherwise, the respondents have placed the relevant facts for doing so.
Considering the matter in the light of the counter affidavit, this Court finds no merit in the application. It is, accordingly, dismissed.
