The Court has been granting indulgence repeatedly to the Respondent Corporation upon being informed that the matter relating to winding up though being dismissed, steps were being taken for its restoration before the Company Judge. However, despite the Court having granted indulgence on 28.09.2015, 05.10.2015, 29.10.2015 and 26.11.2015, the position still remains that no petition in the eyes of law for winding up is pending before the Court with regard to the Respondent Corporation. Accordingly, there being no dispute to the fact that the petitioner is entitled to his retiral benefits, the Court has no option
