In the background of land dispute, it has been alleged by the informant Sanjay Ram that the accused named therein including the petitioner armed variously made criminal trespass, abused and during course thereof, petitioner Bhola Ram had inflicted Dab blow (sharp cut weapon) causing injury over his head. His wife as well as his younger brother rushed in his rescue who were also assaulted. Accused persons also snatched away Mangal Sutra as well as earring. Paragraphs 15, 16, 17 of the case diary contain the injury report whereupon it is apparent that no apparent injury has been found over the person of Vinay Kumar, younger brother of informant as well as Sumitra wife of informant. So far injury over person of informant is concerned, single injury has been found, laceration over scalp (L) tempo occipital region 2" x 1/" x cut icle deep, simple in nature caused by hard and blunt substance, which also rules out assault having been inflicted by means of sharp cut weapon.
Patna High Court Cr.Misc. No.6422 of 2015 (3) dt.27-04-2015 Accordingly, petitioner Bhola Ram is directed to surrender before the learned lower court with a prayer for bail which the learned lower court will favourably consider in light of finding recorded herein above.
With the aforesaid direction, instant petition is disposed of.
