The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 307, 379 and other allied sections of the Indian Penal Code. As per the prosecution case, allegation against petitioners is that they along with other co-accused persons assaulted the informant with lathi, danda and iron rod as a result of which he sustained injuries.

It is submitted that there is general and omnibus allegation of commission of assault against all the accused

Patna High Court CR. MISC. No.15261 of 2023(2) dt.18-05-2023 2/2 persons and no specific overt act has been alleged against the petitioners. There is case and counter case. The doctor has found the injuries sustained by the informant simple in nature. Petitioners claim clean antecedents.

Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 6th, Bhojpur at Ara in connection with Chauri P.S. Case No. 78 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
