JUSTICE MADHURESH PRASAD ORAL ORDER 18-01-2018 Heard counsel for the petitioner and the State. Petitioner seeks bail in a case registered under Section 392 of Indian Penal Code.

It is submitted that the petitioner, who having clean antecedent, has been implicated in this case by the informant who is his Gotiya due to some pending lnd dispute. Drawing attention of the Court towards the statement of the victim under Section164 of Criminal Procedure Code, it is submitted that from the same, it is apparent that no such allegation has been made for the offences under which the case has been lodged about three months after the victim was allegedly taken away by the petitioner. On the basis of such allegations, the petitioner is in custody since 07.11.2017. Considering the submissions made on behalf of the

Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge I, Gopalganj in Kuchaikote Police Station Case No 303 of 2017 subject to the following conditions:

(i) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(ii) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
