Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 120B of the Indian Penal Code.
The murder of the son of the informant was committed, while he was sleeping in his room by causing injury with sharp cutting weapon. A blood stain spade was also noticed there. Suspicion is that petitioner, who is brother of the informant might have committed the murder, as the petitioner was seen in suspicious circumstances in the night. Submission is that due to family dispute, false allegation is there. There is no direct allegation, nor any motive is established against the petitioner for the crime alleged.
Patna High Court CR. MISC. No.12670 of 2019(3) dt.08-05-2019 2/2 Petitioner is in custody since 21.07.2018. Investigation of the case is already complete.
Considering the general and omnibus nature of allegation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Ghoshwari Police Station Case No.48 of 2018, subject to condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
