In this case, the petitioner is seeking regular bail in connection with Sessions Trial No.34 of 2016, arising out of Bangaon P.S. Case No.93 of 2015, registered for the offence punishable under Sections 364, 302, 201 and 379/34 of the Indian Penal code.
Earlier, the petitioner has moved before this Court for bail in Criminal Miscellaneous No.53579 of 2016 and this Court vide order dated 15.02.2017 rejected the bail application of the petitioner and directed the trial court to conclude the trial within two months.
It appears from the report of the Additional District & Sessions Judge-II, Saharsa, that the prosecution has closed his
Patna High Court Cr.Misc. No.24142 of 2017 (3) dt.09-08-2017 2/2 evidence.
In such view of the matter, this Court is not inclined to grant bail to the petitioner. Now, it is the turn of the defence as the conclusion of the trial depends upon co-operation extended by the defence. If the defence extends the co-operation, in such circumstance, the Court below will conclude the trial within a period of three months from the date of receipt/production of a copy of this order.
