JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-04-2018 Heard learned counsel for the petitioner, counsel appearing on behalf of the State as well as opposite party No.2. The petitioner apprehends his arrest in connection with Gaunaha P.S. Case No.24 of 2017 registered under Sections 420, 406, 409 of the Indian Penal Code.
The learned counsel for the petitioner submits that there is allegation of receipt of 726 and odd quintal paddy for the year 2012-13 and he submitted that the total cost of the paddy is Rs.4,69,703/-. There is allegation of non-payment of balance amount of Rs.2,90,730/-. From perusal of Annexure-2, the certificate issued by the District Manager, BSFC that petitioner has paid entire amount, i.e., Rs.4,70,500/- and nothing is

Referring to Annexure-2, the learned counsel for the petitioner submits that in view of the above entire allegation leveled against the petitioner is wrong. Considering the facts aforesaid and the fact that certificate as Annexure-2 issued by the District Manager, BSFR, the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt / production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, West Champaran at Bettiah in connection with Gaunaha P.S. Case No.24 of 2017., subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
