The petitioner seeks regular bail in connection with Special Case No. 10175 of 2018 arising out of Mokama P.S. Case No. 246 of 2018 registered for the offence punishable under Sections 30(a) and 41 of the Bihar Excise Act. The allegation is regarding recovery of 1240 liters of illicit liquor from the house of one co-accused, namely, Piku Singh.

The learned counsel for the petitioner submits that neither the house belongs to the petitioner nor any recovery has been made from the conscious possession of the petitioner and the petitioner has been falsely implicated in the present case on account of one other case of similar nature being pending

Patna High Court CR. MISC. No.11898 of 2019(2) dt.26-02-2019 2/2 against him. Lastly, it is submitted that the petitioner is languishing in custody since 01.02.2019.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Special Case No. 10175 of 2018 arising out of Mokama P.S. Case No. 246 of 2018.
