JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-04-2019 This is an application for grant of anticipatory bail in connection with Vaishali P.S. Case No. 314 of 2018, disclosing offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
Allegation as per F.I.R. is that one Bolero vehicle was intercepted and five accused persons were apprehended and there was recovery of 171 liters of foreign liquor and the apprehended accused persons disclosed the name of the petitioner as driver of the vehicle.
Submission of learned counsel for the petitioner is that the petitioner has falsely been implicated in this case and he has no criminal antecedent and except disclosure of co-accused persons, there is absolutely nothing against him. Heard learned A.P.P. also.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise cum A.D.J. II, Hajipur, Vaishali, in connection with Vaishali P.S. Case No. 314 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
