Petitioner is an accused in connection with Tatarpur P.S. Case No. 211 of 2019 for the offence registered under Sections 363, 365, 328, 376, 323 and 325 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, there was free fight between the parties in which both sides have sustained injuries for which case and counter case have been lodged by both the parties. No any independent witnesses have supported the prosecution version. The petitioner is rotting in judicial custody

Having considered the above facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing personal bond to the satisfaction of IX- A.D.J., Bhagalpur in connection with Tatarpur P.S. Case No. 211 of 2019.
