JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 25-02-2022 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner as well as learned APP for the State through video conferencing. The petitioner apprehends his arrest in connection with Hajipur Sadar P.S. Case No. 509 of 2020, registered for the offences punishable under Sections 399, 402, 413, 414 of the Indian Penal Code and 25(1-b)a, 26 & 35 of Arms Act.

As per allegation, co-accused Santosh Kumar sold the stolen golden chain to the petitioner who is a goldsmith. Learned counsel for the petitioner is not named in the FIR. Nothing incriminating was recovered form his possession and his name has only been figured in the confessional statement of arrested co-accused.

Paragraph No. 16 of the case diary discloses the criminal history of co-accused Santosh Kumar and coaccused Hanumat Kumar. A number of cases are pending against other co-accused, but so far as present petitioner is concerned there is no criminal antecedent has been reported in the case diary. Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Vaishali at Hajipur in connection with Hajipur P.S. Case No. 509 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.

Office shall ensure that all defects are removed by the petitioners within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court. (Nawneet Kumar Pandey , J) SONALI/- U T
