JUSTICE SANJAY PRIYA ORAL ORDER 24-05-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Riga P.S. Case No. 138 of 2016 instituted for the offence under Section 47(A) of Bihar Prohibition and Excise Act, 2016.
It has been submitted on behalf of the petitioner that 64.320 litres of illicit liquor has been recovered from the house of one Ram Pratap Mahto and one co-accused Mahendra Mahto was apprehended by the police, who disclosed the name of this petitioner. The co-accused persons namely, Mahendra Mahto and Shyam Kumar @ Shyam Kumar Sah have already been granted bail by a coordinate Bench of this Court vide order dated 14.12.2016 and 13.2.2017 passed in Cr. Misc. 48642 of 2016 and 4264 of 2017 respectively.
Patna High Court Cr.Misc. No.24258 of 2017 (2) dt.24-05-2017 2/2 Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, in connection with Riga P.S. Case No. 138 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
