This is an application for regular bail in connection with Banka P. S. Case No. 864 of 2017 registered for the offences punishable under Sections 379 and 411 of the Indian Penal Code.
Informant in his written complaint has stated that on 23.12.2017 at about 10 A.M. he went to his office after parking his vehicle and when he came out of office after finishing his work he found that his motorcycle was stolen. A case was registered against unknown. However, the motorcycle was recovered on 25.12.2017 and petitioner was arrested on the same date in which he confessed his crime.
It has been submitted on behalf of the petitioner that he is innocent and has falsely been implicated in this case. He

No.14627 of 2018(3) dt.09-04-2018 2/2 himself was a victim in an incident in which a case was lodged on 18.12.2017 in Aligarh where he was admitted to hospital and he was discharged on 21.12.2017 and thereafter he came to his house at Banka on 24.12.2017. It has further been submitted that petitioner has no criminal antecedent and he is in custody since 25.12.2017.
Considering the facts and circumstances of the case, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka, in connection with Banka P. S. Case No. 864 of 2017.
