Mr. Damodar Prasad Tiwary ====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 08-02-2022 Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the State through video conferencing.

The learned counsel for the petitioner is directed to remove all the defects pointed out by the office within one month.

The petitioner apprehends his arrest in connection with Maharajganj P.S. Case No. 137 of 2020 registered for offence punishable under sections 341, 323, 324, 379, 307, 504/34 of the Indian Penal Code.

The allegation against the petitioner is that he stabbed the brother of the informant.

The learned counsel for the informant has submitted that there is direct allegation against the petitioner that he stabbed the informant's brother.

The FIR shows that the accused persons of this case including the present petitioner were also accused in another case of motor cycle theft and the informant has given his name in that motor cycle theft case and it was the reason that they have assaulted the informant's brother. The paragraph no. 3 of the bail petition shows that another case, i.e. Daraundra P.S. Case No. 78 of 2019, was also against the petitioner. Considering the fact that the petitioner is tampering with the evidence and threatened the witnesses of the motor cycle theft case, I am not inclined to grant anticipatory bail to the present petitioner. Accordingly, the prayer for anticipatory bail is rejected.

Office shall ensure that all defects are removed by the petitioners within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
