Petitioner, already in custody, seeks bail in connection with sessions Trial No. 711 of 2015 arising out of Ghorasahan P. S. Case No. 247 of 2015, registered under Sections 413, 414, 399, 402/34 of the Indian Penal Code. Learned counsel for the petitioner submits that signature of the petitioner is not on the seizure list and it is alleged that one stolen motorcycle has been recovered from his possession moreover, the charge has been framed against the petitioner but even after lapse of one year, not a single witness has been examined.

No.13758 of 2018 (2) dt.08-03-2018 2/2 Having considered the said facts and circumstances, the petitioner, Pardeshi Rai is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge 12th, Motihari, East Champaran in connection with Sessions Trial No. 711 of 2015, arising out of Ghorasahan P.S.Case No. 247 of 2015, subject to the conditions that the petitioner shall be present on every day before the trial court and in case of absence on two consecutive dates without any reasonable cause, his bail bond shall be liable to be cancelled.
