The petitioner is languishing in custody for the offence punishable under Section 394 of the Indian Penal Code. Some unknown person committed loot in the gas godown of the informant in his presence. During investigation one Govind Kumar Singh was apprehended by the police and he disclosed the name of the petitioner as co-culprit. Thereafter, from the house of the petitioner empty gas cylinder was recovered.

Submission is that neither the petitioner was put on Test Identification Parade nor the seized gas cylinder was put on

Investigation of the case is already complete and petitioner is ready to cooperate with the trial. Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Basopatti P.S. Case No.38 of 2016, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below having immovable property in his name.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
