JUSTICE DINESH KUMAR SINGH ORAL ORDER 01-03-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 323, 325, 307, 504, 506 of the Indian Penal Code and 27 of the Arms Act. Prosecution case is that on 13.11.2015 at 1.00 PM, 1520 cows of the villagers of Karma Fatehpur entered into the paddy field of villagers of Parasiya and damaged the crops. In the meantime, the petitioner and other started taking away the cows. On protest being made the accused started assaulting with 'lathi' when co-accused Arun Mehta resorted to fire causing injury to Karu Singh.

It is submitted by learned counsel for the petitioner that accusation of firing is against co-accused Arun Mehta and the injury report of Karu Singh reflects that he received only fire arm

Patna High Court Cr.Misc. No.9448 of 2016 (2) dt.01-03-2016 2/2 injury. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the specific accusation against co-accused Arun Mehta, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Aurangabad in connection with Tandwa P.S. Case No.47/2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
