Perused the impugned order dated 05.08.2016 passed by Sub-Judge-III, Saharsa in T.S. No.80 of 08, whereby the learned court below has allowed the amendment application filed by the plaintiff-respondents.

From perusal of the amendment application, it appears that the plaintiff filed the amendment application only to make correction in the boundary of the suit property. The plaintiff has only examined three witnesses, according to the learned counsel for the petitioners. Therefore, there is no question of any prejudiced to the petitioners arise. The amendment sought for is in the nature of correction only.

I do not find any reason to interfere in the impugned order and thus, this Civil Miscellaneous application is dismissed. (Mungeshwar Sahoo, J.) ravi/- U T
