The petitioner seeks regular bail in connection with Raxaul P.S. Case No. 367 of 2020 for the offence punishable under Section 304B/34 of the Indian Penal Code. Chargesheet was submitted under Section 302 of the Indian Penal Code. Vide order dated 21.02.2022, this Court had directed
Patna High Court CR. MISC. No.22798 of 2021(6) dt.22-04-2022 2/2 to call for a report regarding the progress in the trial from the Court of learned Sub-Divisional Judicial Magistrate, Raxaul at Motihari, East Champaran.
In compliance of the said order vide Letter No. 203 dated 08.03.2022, it has been informed by the trial court that considerable progress has taken place in conduct of the trial and only five witnesses are remained to be examined. Taking into consideration the progress which has taken place in conduct of the trial and nature of allegation, I am not inclined to enlarge the petitioner on bail at this stage.
