This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 498A, 304B, 201/34 of the Indian Penal Code.
Learned senior counsel appearing on behalf of the petitioner has submitted that the petitioner is mother-in-law of the deceased and father-in-law of the deceased has been granted regular by this Court by an order dated 10.04.2015 passed in Criminal Miscellaneous No. 7930 of 2015. He submits that the petitioner being a lady should be given the privilege of
Patna High Court Cr.Misc. No.6512 of 2015 (3) dt.21-05-2015 2/2 anticipatory bail in the facts and circumstances of the case. Learned counsel appearing on behalf of the informant on the other hand, has vehemently opposed the prayer for bail and has submitted that since the occurrence took place in the in-laws' house, no privilege of anticipatory bail could be granted. Considering the submission that the petitioner is the lady and the father-in-law has already been granted regular bail, let the petitioner, abovenamed, in the event of her arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur, Ara in connection with Ara Nawada P.S. Case No. 385 of 2014, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
