This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 341, 323, 385, 307, 504 and 506 of the Indian Penal Code registered in connection with G. B.Nagar P.S.Case No. 22 of 2021. The specific allegation against the petitioner is that he inflicted dab blow on the brother of the informant and made him injured.

The learned counsel for the petitioner has submitted that he is innocent and has falsely been implicated in this case. As a matter of fact, there is previous enmity between both the parties due to business rivalry. The injuries are simple in nature

Patna High Court CR. MISC. No.13747 of 2023(2) dt.12-04-2023 2/2 and the petitioner is in custody since 02.12.2022. On the other hand, the learned APP has opposed the prayer for bail.

Considering the above facts and circumstances, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Siwan in connection with G.B.Nagar P.S.Case No. 22 of 2021, subject to the following conditions:-

1. The petitioner shall cooperate in the disposal of trial and make available available as and when required by the court.

2. If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitiones and the learned court below will take decision in accordance with law.
