JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 29-09-2020 Heard learned counsel for the petitioner, Mr. Ram Anurag Singh, learned APP for the State and Mr. Srikant Saran Singh, learned counsel for the informant.

Petitioner in this case is seeking pre-arrest bail in connection with Kahalgaon (Rasalpur) P.S. Case No.775 of 2019 registered for the offence under Section 135 of the Electricity Act.

In view of the previous order dated 25.09.2020, learned counsel for the petitioner submits that presently the petitioner has no apprehension of his arrest as he has already executed the bond before the investigating officer. Learned counsel submits that as and when required he would appear

Patna High Court CR. MISC. No.17522 of 2020(6) dt.29-09-2020 2/2 before the learned court below and shall pray for regular bail. This application is thus being disposed of with an observation that as and when required the petitioner will appear before the learned court below and shall not avoid any notice/summon for appearance either issued by the investigating officer or the learned court below. In such circumstance, if the petitioner applies for regular bail, the learned court below shall consider the same on its own merit but keeping in view that the petitioner has been granted benefit of Section 169 Cr.P.C. in course of investigation. It will, however, be an independent consideration.
