The appellant seeks bail in Sakra P.S. Case No.334 of 2019, registered under Sections 341, 323 and 504 of the Indian Penal Code read with Sections 3(i) (r) (s) of the SC/ST Act. The informant alleged in his fardbeyan that on 24.06.2019 while he was sitting on the darwaza of Umesh Paswan and talking with Dinesh Lal Mahto, in the meantime, Suresh Thakur asked for tobacco. When the informant disclosed that he did not have tobacco, Suresh Thakur abused him by naming his caste and assaulted him with fists and slaps. Blood started oozing from his nose.

Learned counsel for the appellant submits that some scuffle took place on account of petty dispute and for that the appellant is in jail since 22.11.2019. The doctor found the

Taking into consideration the facts and the nature of allegations made against the appellant and the fact that the appellant is in jail since 22.11.2019, appellant, namely, Suresh Thakur is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, SC/ST (POA) Act, Muzaffarpur in connection with Sakra P.S. Case No.334 of 2019.

The appeal is accordingly allowed.
