The petitioner seeks bail in connection with Chapra Muffassil P.S. Case no. 10 of 2018 registered under Sections 272, 273/34 of the Indian Penal Code and Sections 30, 38 and 41 of Bihar Prohibition & Excise Act-2016.

120 lts. of country made liquor and some utensils are said to have been recovered from chawan located in P.S. Chapra Muffassil and two accused persons including the petitioner were apprehended while other two managed to escape. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his conscious physical possession. He has no concern either with the seized

Patna High Court Cr.Misc. No.6899 of 2018(2) dt.12-02-2018 2/2 liquor or with the place of recovery of the same. He has no criminal antecedent. He has been languishing in custody since 06.01.2018.

Considering the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned 6th Additional District and Sessions Judge, Saran at Chapra in connection with Chapra Muffassil P.S. Case no. 10 of 2018.
