JUSTICE BIRENDRA PRASAD VERMA ORAL ORDER 23-11-2016 After having heard the parties for sometime, this Court finds that the present writ petition is very sketchy one. All the relevant facts regarding the land acquisition proceeding in question and details of the lands belonging to the petitioner have not been disclosed in the present writ petition. The learned AC to GP-24, appearing on behalf of the respondent nos.1 to 4 and the learned counsel appearing on behalf of the respondent no.6 have rightly raised their objections that the relevant facts have not been properly stated and relevant materials/notifications have not been brought on the record on behalf of the petitioner in the present writ petition; therefore, they are not in a position to file effective counter affidavits.

Patna High Court CWJC No.7339 of 2014 (2) dt.23-11-2016 In above view of the matter, the learned counsel appearing on behalf of the petitioner seeks permission to withdraw the present writ petition with a liberty to file a fresh writ petition in the same subject matter, after bringing on the record all the relevant orders passed and notifications issued in the land acquisition case in question as also the details of the lands claimed by the petitioner and further after bringing on the record all the subsequent developments, which might have taken place during the interregnum period.

Permission is accorded.

The writ petition stands disposed of as withdrawn with the liberty aforesaid.
