The petitioner seeks bail in connection with Gaya Rail P.S. Case No.52 of 2010 registered under Sections-147, 148, 149, 307, 427 of the Indian Penal Code, Sections-150 & 151 of the Railway Act and Section-17 of the Criminal Law Amendment Act.

As per the prosecution case, the petitioner is said to have blown the railway track in a bid to cause damage to the train. Learned counsel for the petitioner submitted that the petitioner is not named in the F.I.R. The petitioner is neither apprehended on the spot nor any causality has been caused on the hands of the petitioner. He has been languishing in jail custody since 06.02.2017. Learned counsel for the petitioner further submitted that he has been falsely implicated in the case.

No.24108 of 2017 (02) dt.22-05-2017 2/2 In the facts and circumstances, the petitioner, namely, Bachu Yadav alias Bachu ji be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Gaya Rail P.S. Case No.52 of 2010.
