JUSTICE BIRENDRA KUMAR ORAL ORDER 12-03-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341,323,324,307,379,504,506,34 of the Indian Penal Code. During course of occurrence of assault, the petitioner allegedly caused injury with Farsa at the head of the informant. The Doctor has found an incised wound at the left half of forehead. Others assaulted with Lathi and Doctor has found other injuries also on non-vital part of the body. Considering the fact that petitioner had knowledge that his act might cause death, I am not inclined to enlarge him on anticipatory bail in connection with Harsidhi

Patna High Court CR. MISC. No.15260 of 2019(2) dt.12-03-2019 2/2 P.S.Case No.334 of 2018, G.R.No.5660 of 2018 pending in the court of learned Chief Judicial Magistrate, East Champaran at Motihari. Accordingly, prayer is refused.

Petitioner may surrender and pray for regular bail within three weeks and prayer shall be disposed of without being prejudiced by this order.
