The petitioner seeks regular bail in connection with Kotwali P.S. Case No. 561 of 2022, registered for the offences punishable under Section 379 of the Indian Penal Code. As per the prosecution case, motorcycle of the informant was stolen by unknown person and during the investigation, the petitioner was apprehended with alleged stolen motorcycle.

Learned counsel for the petitioner submits that only on the basis of suspicion, the petitioner was arrested, who is in jail custody since 10.11.2022 and he has no criminal antecedent. Charge-sheet has already been submitted and there is no chance of any tampering of evidence in this case by the petitioner.

Patna High Court CR. MISC. No.13901 of 2023(2) dt.10-05-2023 2/2 Learned APP for the State has opposed the prayer for regular bail of the petitioner.

Considering the facts and circumstances of the case let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned in connection with Kotwali P.S. Case No. 561 of 2022.
