JUSTICE RAMESH KUMAR DATTA ORAL ORDER 26-10-2016 Heard learned counsel for the petitioner and learned counsels for the Ara Municipal Corporation and for the State. C.W.J.C. No.6777 of 2010 was disposed of by order dated 14.11.2013 with the direction to the Municipal Commissioner to hear the parties and dispose of the matter with regard to the illegal encroachment.

In the show cause filed on behalf of the opposite parties of the Municipal Corporation, it is stated that the order under contempt has been complied with by the order dated 14.09.2016 passed by the Municipal Commissioner, Ara Municipal Corporation wherein it has been found that there is encroachment.

Patna High Court MJC No.1475 of 2014 (4) dt.26-10-2016 The direction for removal of the illegal encroachment within 30 days has been issued. No further action for removal of the same has been taken, as there is a provision for appeal against the said order.

In the aforesaid facts and circumstances, it appears that the order under contempt dated 14.11.2013 has been complied with, though belatedly.
