Petitioner seeks regular bail in Ahiyapur P.S. Case No.657 of 2017 instituted for the offence under Sections 363, 366A/34 of the I.P.C..
Informant who is the uncle of the victim girl in his written statement has stated that his niece, namely, Neha Kumari aged about 14 years was residing with him for two months and on 11.08.2017 petitioner kidnapped her six days earlier but she has not returned as yet. The girl was recovered by the police and her statement was recorded under Section 164 Cr.P.C. in which she has stated that she had not been kidnapped rather she had gone with the petitioner on her own volition and she has solemnized
Patna High Court Cr.Misc. No.2184 of 2018 (3) dt.08-02-2018 2/2 marriage with the petitioner. In the medical report her age has been assessed as 16 to 17 years.
It has been submitted by the petitioner that he has clean antecedent and he is in custody since 03.11.2017. Considering the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the C.J.M., Muzaffarpur, in Ahiyapur P.S.Case No.657 of 2017.
