This is an application seeking anticipatory bail in a case registered for the offences punishable under Section 7 of the Essential Commodities Act.
Allegedly, 69 bags of wheat and 3 bags of rice were seized in course of raid conducted by the informant, the Marketing Officer of Amarpur Block, loaded on a pick-up Van. The driver of the vehicle is said to have taken the petitioner's name, who is a P.D.S. dealer, as the person on whose instruction the goods were being transported.
Learned counsel for the petitioner submits that despite the request made by the petitioner to verify the stock of
Patna High Court Cr.Misc. No.6518 of 2015 (3) dt.21-05-2015 2/2 lifted commodities from the petitioner's fair price shop, no steps were taken in this regard. It has been stated that petitioner has no criminal antecedent.
In view of the submission as above, let the petitioner, abovenamed, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Amarpur P.S. Case No. 330 of 2014, G.R. No. 2264 of 2014, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
