JUSTICE ARUN KUMAR ORAL ORDER 03-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 27.11.2017, seeks bail in Gogri PS Case No. 499 of 2017 registered under Section 414 of the IPC and Sections 25(1-A), 25(1AA), 35 of the Arms Act. The allegation in brief is that on secret information to the police that criminals have assembled at a place, the police reached there and apprehended three persons and from the possession of the petitioner one mobile is said to have been recovered but no paper was shown.

Learned Counsel for the petitioner submits that the so called mobile is personal mobile of the petitioner, he has no other criminal antecedent except a case lodged under Sections 307 and other sections of the IPC.

Having considered the said facts and circumstances, the petitioner, namely, Md. Harun is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Ms. Simmi Kujur, Judicial Magistrate, lst Class, Khagaria in connection with Gogri PS Case No. 499 of 2017.
