Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 25(1B)a, 26, 27,35 of the Arms Act. The prosecution case is that during patrolling the informant being the S.I. of Choutham Police Station received information of firing made by this petitioner, leading to raid, on chase one person was apprehended, who disclosed his name as Murari Kumari, from whom country made pistol was recovered, who suggested that the petitioner resorted to fire and handed over the arms to the apprehended co-accused Murari Kumari.

It is submitted by the learned counsel for the petitioner that even assuming the accusation no offence under

Patna High Court Cr.Misc. No.8559 of 2016 (2) dt.23-02-2016 Sections 25(1-B)a, 26, 27, 35 of the Arms Act is made out. Considering the fact that actual recovery was made from Murari Kumar, it is a case for consideration of prayer for regular bail, let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Choutham P.S. Case No. 139 of 2015, pending in the court of learned A.C.J.M.-II, Khagaria. With the above observation this application is disposed of.
