JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 03-03-2020 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in connection with Masaurhi P.S. Case No. 27 of 2020 for the offence under Sections 341, 323, 379, 427, 504, 506/34 of the Indian Penal Code.

Allegation against the petitioner is that he along with others assaulted the informant and took away Rs.1,15,000/- from the pocket of the informant and golden chain from his neck.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. He further submits that there is case and counter case. He further submits that except Section 379 of the Indian Penal Code, others offences are bailable in nature.

No.10832 of 2020(2) dt.03-03-2020 2/2 Considering the fact that except Section 379 of the Indian Penal Code other offences are bailable in nature and also the fact that there is case and counter case, the petitioner named above, in the event of arrest or surrender before the court below within one month from today, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., Masaurhi, Patna in connection with Masaurhi P.S. Case No. 27 of 2020 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
